Agreement and Scope
These Terms of Service ("Terms") govern your access to and use of websites, products, and services provided by MARIA AI ("we," "us," or "our") that link to these Terms (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.
If you use the Services for an organization, you represent that you have authority to bind that organization. "You" then includes both you and the organization. If you do not agree to these Terms, do not use the Services.
Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a binding agreement. You must provide accurate account information, keep credentials confidential, and promptly notify us of suspected unauthorized access.
You are responsible for activity under your account and for ensuring that authorized users comply with these Terms.
Customer Agreements
Paid or enterprise Services may be governed by an order form, master services agreement, data processing agreement, or other written agreement. That agreement controls if it conflicts with these Terms. Fees, usage limits, service levels, support, and subscription periods are set out in the applicable order form or service description.
Acceptable Use
You may not use the Services to:
- Break the law, violate another person's rights, or facilitate harmful activity.
- Upload content you do not have the right to use or process.
- Distribute malware, spam, or deceptive communications.
- Probe, disrupt, overload, or bypass security or access controls.
- Reverse engineer or extract source code except where law expressly permits it.
- Use automated means to access the Services outside documented interfaces or limits.
- Misrepresent AI-generated content as human-generated where disclosure is required.
We may investigate suspected violations and restrict access when reasonably necessary to protect the Services, users, or third parties.
Customer Content
You retain ownership of content you submit to the Services. You grant MARIA AI a limited right to host, copy, process, transmit, and display that content only as needed to provide, secure, support, and comply with law in connection with the Services.
You are responsible for your content and for having all rights, notices, and consents required to provide it to us. Additional content terms may appear in a customer agreement or product documentation.
AI Output and Responsible Use
AI-generated output may be inaccurate, incomplete, or similar to output provided to other users. You must evaluate output for your use case and use appropriate human review before relying on it, especially for legal, medical, financial, employment, safety, or other high-impact decisions.
You are responsible for how you use and disclose output and for complying with laws and third-party rights. We do not guarantee that output is unique, accurate, or fit for a particular purpose.
Our Services and Intellectual Property
MARIA AI and its licensors own the Services, including software, designs, documentation, trademarks, and other materials, excluding customer content. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Services. No other rights are granted.
Third-Party Services
The Services may integrate with or link to third-party services. Those services are governed by their own terms and privacy practices. MARIA AI is not responsible for third-party services and does not control their availability, security, or content.
Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, fail to pay amounts due, or if continued access could harm the Services or others. Where practical, we will provide notice and an opportunity to resolve the issue.
Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available." MARIA AI disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant uninterrupted or error-free operation.
Limitation of Liability
To the maximum extent permitted by law, MARIA AI and its affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities. For Services not governed by a separate customer agreement, MARIA AI's total liability arising out of or relating to the Services will not exceed the greater of amounts you paid to MARIA AI for the applicable Service during the 12 months before the event giving rise to liability or USD 100. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.
Changes and Applicable Law
We may update these Terms as the Services or legal requirements change. We will post the revised Terms and update the effective date. If a change materially reduces your rights, we will provide additional notice where required. Continued use after the updated Terms take effect means you accept them.
A signed customer agreement controls its governing law and dispute process. Otherwise, applicable law governs these Terms without limiting rights that cannot be waived under local law.
